| Our Medical Expertise |
An Unbeatable Team |
|
Serious injury and death cases require the utmost in attorney
skill and experience. But that's just half of the equation.
Catastrophic cases from an accident or
from medical malpractice (such as brain injury, birth trauma, paralysis, disfigurement, severe burns,
or wrongful death) require medical expertise, too.
These cases demand, from beginning to end, the expertise of a medical team to oversee the complex
medical issues that are so important.
|
Our team, by combining law and medicine, is uniquely qualified
to represent you or your organization.
We know of no other law firm comprised of an attorney who is also a medical doctor and an attorney
who is a registered nurse. This truly is an unbeatable team.
|
| Passionate Dedication |
Top Rated |
|
Winder & Haslam focuses on such cases in which medical knowledge is as important as legal. So,
unlike other firms, we have a lawyer who is also a clinically experienced doctor (a former head of
a hospital emergency room) and a lawyer who is a registered nurse as members of our team.
They work closely with our clients and other attorneys, from the initial interview through settlement
or trial, overseeing medical issues, advising on strategy, and recruiting top-notch medical experts
critical to an excellent outcome.
|
Winder & Haslam has an exceptional track record of success
in litigation. The firm and its attorneys have received the highest ratings by national law registries
and directories and are recognized as preeminent in ratings by judges, other attorneys and clients. |
| Our Advantage Benefits You |
Recognized by "The Best Lawyers in America" |
|
Other law firms, by contrast, constantly struggle to understand the complex
medical issues in cases. They also struggle to find a doctor to consult on your case.
Our medically
trained and practicing attorneys can often evaluate the merits of a case without the need for external
advice. This is cost effective, less time consuming and more effective in obtaining results.
|
The national guide to legal excellence, "The Best Lawyers
in America," has inducted Donald J. Winder and David J. Weissman from our firm as members of its prestigious
rank. Their bi-annual publication is based on surveys by lawyers and recognized as "the most respected
referral list of attorneys in practice." Lest than 2% of all attorneys in Utah have been so honored. |
| We Connect |
Trial Academies |
|
We speak the right language. Our unique medically trained attorneys are just

Winder & Haslam has one of the most unique and powerful tools to handle complex medical and health
litigation matters. Complex medical and health matters require, from beginning to end, the expertise
of medical and legally trained professionals who understand the implications that can make or break
your case. Winder & Haslam currently has 2 medically trained attorneys with direct experience in
the medical industry.
|
Donald J. Winder has also been inducted into the American
Board of Trial Advocates (ABOTA) and the National Board of Trial Advocacy (NBTA), two of the nation's leading
trial academies.
Mr. Winder serves on the National Board of Directors of ABOTA and is the only Civil Trial Diplomate
in Utah recognized by the NBTA.

| Our Experienced Doctor |
Inducted into Primerus Law Firms |
|
Our of counsel attorney and medical consultant, Robert K.
Rothfeder, M.D.,
J.D., was formerly the Emergency Department Director at Lakeview Hospital, in Bountiful, Utah, for
17 years.
Spending time in the emergency room, Dr. Rothfeder encountered a myriad of medical issues. At Lakeview,
he was truly a doctor's doctor. Dr. Rothfeder was educated at the University of Minnesota Medical
School and trained in emergency medicine at LDS Hospital in Salt Lake City, Utah.
Dr. Rothfeder has been in clinical practice for the past 28 years, and he continues to this day.
In the early 1980s, Dr. Rothfeder developed an interest in the legal system and obtained his Juris
Doctor from the University of Utah College of Law in 1984.
Today, Dr. Rothfeder partners with our firm's top-rated attorneys, assisting with complex medical
and legal issues.
|
Winder & Haslam also is a proud member of the International
Society of Primerus Law Firms, an international association of law firms of the highest quality.
Primerus is very selective in its membership. Those it selects and inducts after rigorous screening
must maintain and adhere to the highest standards of work, education, integrity, civility, professional
education, reasonable fees and community service.
The Primerus seal assures one of the utmost qualities in legal counsel anywhere.

| Our Experienced Nurse |
Martindale Hubbell's Top Rating |
|
Our registered nurse, Linette B. Hutton, R.N., J.D., received her bachelors
degree in Nursing from the University of Utah in 1974. As a registered nurse, Ms. Hutton devoted
the better part of 15 years to serving patients in cardiac and intensive care units.
In 1989, Ms.
Hutton decided to expand her education by attending the California Western School of Law and received
her Juris Doctor Degree (cum laude) in 1992.
Today, Ms. Hutton combines the expertise that she's
obtained from both of these fields to help sort out the complexities of medical issues.
|
The national and independent legal rating service, Martindale-Hubbell,
has awarded Winder & Haslam with the highest achievable rating (AV-"preeminent legal ability and very
high ethical standards.").
An attorney must rank in the top of the profession by confidential surveys
of lawyers and judges even to be considered for this top rating. Martindale-Hubbell also recognizes
the firm of Winder & Haslam in its list of "Preeminent" law firms in the world.

| The Power of Reason |
Selected by Other Lawyers |
|
Contrary to popular belief, not every attorney has courtroom experience. Most
attorneys, in fact, rarely step into a courtroom and few have ever tried a case to a jury. Those
who have been successful in court are more discerning in the cases they will accept, have more clout
in negotiations and have more credibility with judges, opponents and decision makers.
Few attorneys anywhere can match our expertise with matters involving serious and complex medical
issues. All attorneys at Winder & Haslam have an active in-court trial practice. Winder & Haslam
has conducted numerous jury and bench trials to successful resolutions. We have further obtained
successful results in arbitration.
|
Our team of skilled professionals and our outstanding
case results have served our clients well.
Many clients come to us at the recommendation of other attorneys—educated professionals who
know the legal system and of our skill, resources, preparation, talent and exceptional track record
in handling very large and difficult cases successfully!
Our peers want to make sure their families, colleagues, friends and clients are represented only
by the most qualified firm to advocate their position.
Our peers know they can trust us completely. We work hard to exceed these high expectations, maintain
trust, and secure the best results.
|
| Understanding |
|
Appearing in court and actually trying cases has also taught us a lot about
jurors. We've learned that jurors can be quickly bored with legal arguments and hopelessly confused
about injuries, medicine and medical issue.
We've learned to captivate the attention and concern of juries. We explain the medical issues to
them in a plain language and demonstrate the issues in a straightforward manner.
We've learned not only to build powerful cases and to always arrive exceedingly well prepared, but
also to present the cases in a clear, compelling manner. Because, ultimately what matters most isn't
what an expert says, it's what jurors comprehend and believe
